Tourism promotion’s cozy—and now hot—world

This past spring, blogger and free-lance Web site designer Lance Dutson was sued by the Maine Office of Tourism’s New York advertising agency, Warren Kremer Paino, for defamation because of the manner in which he criticized the agency’s promotion of Maine, particularly in its advertising on the Internet.

A hot war began. First, a national firestorm of blogger scorn and Goliath-versus-David news poured upon the New York firm — and, by association, the Maine tourism office — for suing a 33-year-old, former lumber-company employee sitting at his home-office computer in tiny Searsmont, Maine. Quickly, the administration of Democratic Governor John Baldacci forced Warren Kremer Paino to drop the suit. Meanwhile, of course, Dutson’s blog (mainewebreport.com) became highly popular.

Since the suit, the criticism from Dutson has become a barrage: against tourism director Dann Lewis, against his office’s practices, and even against his wife.

Speaking of wives, it didn’t help to sooth Dutson when Nancy Marshall, the tourism office’s public-relations consultant, complained to Dutson’s wife’s employer about his actions.

Marshall soon apologized to Dutson. Jack Cashman, the state’s development commissioner, says he “reprimanded” Marshall, Lewis, and Warren Kramer Paino for feeding the fire. But he feeds the fire himself by calling Dutson “vindictive” and “mean-spirited.” Lewis’s wife, Sherry Lewis, Cashman says, is “actually afraid for her own safety.”

The feelings run extremely high in the Cross State Office Building.

“Horseshit!” Lewis says angrily about Dutson’s various claims about the tourism office. Lewis is a handsome, polished, 68-year-old Dartmouth man, but he tends to lose his cool, in interviews in his office, at the mere mention of Dutson’s name.

“Our lives have been made a living hell,” says Sherry Lewis, 57, about Dutson’s attacks on her. She broke into tears in one telephone interview.

As in most wars, the feelings run high on both sides.

“This group of people tried to destroy my life,” Dutson says, referring to Warren Kremer Paino and the tourism office, which he also blames for the suit. He forwards to the Phoenix remarks he has found on blogs that could be perceived as personal threats against him and his family.

Dutson’s complaints have run from the petty to the worthy of consideration:

• He generated a recent news story about the fact that one of the Lewises’ cars has a Maine vanity license plate reading “ILOVENY.” Years ago, the Lewises both worked on New York state’s “I Love New York” promotional campaign, and Sherry Lewis is a native New Yorker. Her husband said she bought the plate to show solidarity with New Yorkers after the Sept. 11, 2001, terrorist attacks. This issue made the Associated Press news wire and was in the New York papers. The AP story quoted Jack Cashman: “I don’t think it’s a crime to love New York.”

• Dutson sees as ominous that several Warren Kramer Paino executives have contributed to Baldacci’s re-election campaign.

• He finds “absurd” and inflated the tourism office’s claim that, in a recent 12-month period, visitors drawn to Maine by the state’s tourism Web site spent $156 million. A Kennebunk research firm was paid $90,000 for the survey that produced this number.

A few things need to be clarified here, and well past time, too: Dann Lewis is NOT a bureaucrat. He is an appointed state worker who makes considerably less money than the many union, organized, career bureaucrats who are in their cushy jobs for life - and know it. For the REAL bureaucrats, it is obviously in their own best interest to maintain any status quo affecting the State of Maine. (And such a State it is in, too.) Ms. Bendel is an old personal friend of the Lewis'. When they are in NY (which was once in 2005, and never in 2006) they often stay at her tiny 230 square foot studio apartment, since they have many adopted pets which can't stay in hotels. When Ms. Bendel is in Maine, she stays at the Lewis' home. Mr. Lewis was staying at her place when visiting NY on business, thereby saving the state over $300 a night on exorbitant hotel rates. But he has now been instructed to stay in hotels, no matter how expensive. A very interesting though little-known point about the controversial blogger about whom Mr Taply has written: In 2005, his wife was appointed acting director of the Camden/Rockport/Lincolnville Chamber of Commerce. Shortly thereafter, [Blogger] was appointed as their webmaster. (Hmmm....) During this time, they initiated a "News" link, into which readers could post their own press releases. Ms. [Blogger] was appointed the task of moderating these releases, in order to screen out questionable content. Very soon thereafter, this is what showed up on the C/R/L Chambers' website: http://72.14.253.104/search?q=cache:5cgMmx_XxHMJ:www.visitcamden.com/news/release.php%3FID%3D64+site:www.visitcamden.com+lance+dutson&hl=en&gl=us&ct=clnk&cd=1 This article, written in the third person and disguised as a press release, was the VERY first public word ever uttered about "Pay-per-Gate". Ms. [Blogger] must have missed this article in her duties as moderator, since it stayed up on the website for quite a long time - over a month - until someone in a public relations firm (no names...) finally stumbled on it and had a perfectly understandable reaction... of incredulity. This person called Ms. [Blogger]'s boss to find out what was going on. That's all. This was the one and only so-called "threatening phone call" to Ms. [Blogger]'s boss, with which readers of MWR have been so often reminded. No threats. Nothing. If there are any web professionals reading this, they don't need to be told how mind-bogglingly unacceptable it is for a webmaster to hijack his own client's website like this - especially a public site, and especially in order to post an accusation about a deliberate plot by one of the client's colleagues to drive up advertising costs to local businesses. In the city from which I just moved, any such webmaster would immediately be fired and blacklisted. Mr. Blogger was fired. If Mr. Blogger had approached the MOT as a sane and civilized adult - he may have found some opportunities for consultation work. But instead he chose to label himself as yet another internet troll whose behavior quite frankly defies analysis. Mr. Blogger next began to concoct several ridiulous (and provably untrue) accusations about the Lewis' ethics. Any smoking gun about the BNAS "scandal" is pretty easily dispelled, when one knows the truth. Mr. Blogger now has posession of many documents which can clarify and negate these accusations. (In fact these documents, obtained via FOAA requests have now cost Maine taxpayers nearly $100,000) Yet he chooses to take snippets of these narratives out of context, and invent still more smoking guns where none exist. If it does not support his accustaions, he does not print it. The Lewis's were involved in rescue efforts after 9/11, and found several foster homes in Maine for some of the displaced (and badly trampled and traumatized) pets that were let loose right after the tragedy. In a fit of sentimentality, Ms Lewis ordered the vanity plate "IloveNY"... And the rest of that story is history... Ms. Lewis is from NYC. She has a quick NY temper. In NY, people get mad as hell, then forget about it 5 minutes later. People say what they mean, when they mean it, and then hug each other. They don't do that in Maine. Things are very different in Maine. Not better, not worse. Just different. Ms Lewis is a private citizen with the same rights and privileges as any private citizen in this country. Yet Blogger has loudly and viciously questioned her right to host a fundraising party for a candidate of her choice. If this candidate were one of his own extreme right-wing favorties, would he still consider she had no right? Sherry and Dann Lewis had absolutely nothing to do with the lawsuit against Blogger. He has an email in his posession ultimately stating that Mr. Lewis thought it would be a bad idea. Yet again, he has chosen to isolate a single sentence which could imply - out of context - that Mr. Lewis wanted to sue him. Blogger has been stalking, defaming, and terrorizing these innocent people for over a year. There are many honest and honorable bloggers on the web, and many of us fear that the irresponsible actions of this one frightening blogger will stoke an already growing flame of discontent with bloggers in general, and will jeopardize First Amendment rights for all of us. Something has to be done, and nobody is doing it, because everyone - the author of this article, and others as well, are so full of themselves, and having so much fun playing 'Bob Woodward' in an investigative feeding frenzy, and exposing these evil wrongdoers... ...who rescue cats and dogs, drive second hand cars, and live in a heavily mortgaged middle class home. You people are the real enemies. Get a life.

You know what they say, "two wrongs don't make a right". Regardless of how this information has been exposed - there is some very fishy stuff going on in the Office of Tourism and it sure seems like Mr. Lewis's reactions to being put in the spotlight and the knee-jerk reactions by both Nancy Marshall and Warren Kremer Paino Advertising seem to my observation to be the actions of those who have something to hide. Ms. Lewis's own actions in this matter and involvement with Global/interVISTAS, the BNAS bid and advising the Governor's office on the RFP do not make me feel much sympathy for the pickle she and her husband find themselves in. We have the concept of a free press and transparency in governement for a reason. Seems to me like Mr. & Mrs. Lewis brought their "NY way of doing business" up to Maine where until Mr. Dutson's scrutiny, they were operating outside of the boundries that most reasonable people would consider acceptable (and possibly even legal) for goverment officials or their families. I don't care how much Dann Lewis is paid. He should know the responsibilty that comes along with being government employee. In my experience, if the whole lot had taken Mr. Dutson's original criticism constructively and engaged him in a conversation instead of starting a war (again, for someone with NYC DNA that would have been hard) they could have likely avoided this mess they are in. At this point, enough has been questioned that I can't imagine there not being a formal inquiry into these allegations. I don't envy any of the participants in this situation though I'm glad that the bright light of sunshine is being shined on this issue. FWIW - in reading Mr. Dutson's writings I have never interpreted this to be a partisan issue.

In looking at the cached link from visitcamden.com, a site where Mr. Dutson's wife was employed and Mr. Dutson was the webmaster, I have to agree that this was not an appropriate place for such a criticism. It is written in such a way that does not make it clear that this is Mr. Dutson's own personal opinion and does not disclose his relationship with the Chamber - all pretty standard stuff in the world of professional journalism - bloggers really do need to catch up. Even with the disclosures, this was certainly not the Chamber's intent of having a regional news section on the web site - to provide a vehicle for OpEd content critical of the MOT. I would consider this an abuse that taints Mr. Dutson's judgement - if he wanted to share his opinion on his own blog, that's one thing. There are always two sides to every issue. I think Mr. Dutson is very, very lucky that he did not mention any names (like WKP) in his "article" or maybe that lawsuit could have had some legs. Again, "two wrongs........"

Linda- First of all, I have never been employed by any chamber of commerce. I worked on some very small contract website changes to the CRL Chamber site, as well as a website for an arts festival, but have been a member for several years of that organization. I posted that piece, as was my specific right to, as a member last fall, prior to any working relationship with them. It was a press release. Look at the page more closely and you will see about a half dozen other press releases from other Chamber members there as well, written in the third person, about their own businesses. As a member, one can log in to the site and post these items as they please. The chamber vetts them and decides if they are appropriate or not. My wife was not the director of that chamber at the time it was posted, and was only acting director of that organization for about a month at the end of last year. She had nothing to do with that post, and in fact it remained on the site for at least 6 months before I voluntarily removed it to keep that organization, for which I have done hundreds of hours of volunteer work, from getting involved in the MOT situation. The press release was widely viewed and discussed among employees and board members of that organization, as well as the director at the time it was posted, who my wife worked for. I volunteered to take it down later when Nancy Marshall began contacting chamber board members, and was told by the chamber chair that its removal was not necessary. I logged in and removed it of my own accord, in order to make sure fallout from this conflagration wouldn't affect the chamber of commerce. Your assessment of this situation is brashly incorrect, and if you'd like more details Ms. Hutchins, you can feel free to email me at any time, as you have been for several months about your trailer situation. (If other readers are interested, they can read about Linda Hutchins' unfortunate plight at scammedinmaine.blogspot.com) And further Linda, what is wrong with what I wrote in that post? You act as if it were hidden, when it is published on my business website, I sent it to all the papers in Maine, and I also submitted it online through a press release distribution service. The press release details the early stages of the pay-per-click controversy, an issue any business in Maine or the area served by the CRL Chamber of Commerce should be interested in. It is 100% accurate, does not use hyperbole, and is as fair and benign a representation of the pay-per-click issue that I have probably ever written. And frankly Ms. Hutchins, I think you are being dishonest by acting as an impartial observer here. I am aware of your relationship with Dann and Sherry Lewis, as I am aware of the series of contacts you have made with people in my professional and personal circles. I am happy to discuss points with you if you are concerned somehow with the veracity of what I publish, but I think it's important that readers know where you are coming from. The suggestion that you 'would have called a lawyer' too is absurd. What on earth in that press release is inaccurate? And who would have called a lawyer, the MOT? It is political criticism, of a very specific and wonkish policy issue that no one would have paid attention to if it had not been for the outrageous reaction of your friend Mr. Lewis. The venue it was presented in has similar criticisms of things ranging from local ordinances to cell phone towers. It was meant as a forum for ideas that are important to local businesses, and that is exactly what happened. What people do call lawyers about is when people post untrue things on the internet. When people jump from forum to forum and spread specific and malicious untruths about people, they often times end up getting sued. There is a case in Florida where a woman made claims of another person being a 'fraud' and a 'con artist' in the comments of someone's blog. This woman was found guilty by a jury and a judgement of $11 million was levied against her. It may be worth checking out, Ms. Hutchins.

Is this a Blogger I see before me? I did email said Blogger twice, pointing out his errors. But he ignored my emails. I would much rather have left my comments on his blog, where they may have been seen. But other people who disagree have had their comments deleted. I assumed he would delete mine as well. Yes, Mr. Lewis did have a pretty angry reaction to your calling his wife "Dann Lewis's whore". Go figure. I am a blogger myself, and a very honest one. When I read things that I know are ridiculous and vicious, I worry about my own First Amendment rights. Incidentally, there IS no "Pay-per-Click Controversy". Every expert in the field has decried any wrongdoing on the MOT's part, and I know as a personal fact that they are right. One lone blogger standing up and shouting "Controversy!" over and over again, does not a 'controversy' make. This is all so damned silly. Innocent people have suffered, and the state of Maine has lost almost $100k. Go to sleep, young blogger.

Mr. Dutson: You are the antithesis of honesty and decency. You are in fact, pathetic. You are glib, and have a marginal command of the english language, but you also persist in distortion and speculation with absolutely no regard for facts of truth. Your "conspiracy theories" are rife with an utter disregard for both "timeline and content" that you could easily reconstruct from your numerous and abusive FOAA requests. But of course, the truth would hardly fit into your cowardly agenda. You have managed to avoid (slither away?)from any attempts to air the facts of your multiple crusades against any number of decent and well meaning people that are simply trying to attend to Maine's largest industry. Face-to-face encounters apparently scare you. I challange you to get over your hesitancy and meet with those many persons you have unjustifiably maligned. To quote your latest comment here on Lance Tapley's article: YOU, Mr. Dutson "post untrue things on the Internet", you Mr. Dutson "spread specific and malicious untruths about people"....Perhaps your latest elevation in the Blogosphere was due to the perception of an ill-advised David and Goliath campaign, but now you are making lightly veiled threats against Ms. Hutchins, a fellow blogger who unlike you, posts the truth, and attempts to find decency in most everyone. Linda, most certainly, is an enigma to you and your kind. You, Mr. Dutson, are percieved across the blogosphere and the State of Maine as an example of what Blogging should NOT BE. (Ah hem. ...) Well, I can understand Ms Lewis's anger. I was badly wronged by some local folks, and I have lost my cool over it many times. I'm sure a few phone calls to the Chamber of Commerce would clear up the time line. I have read about legislation that is pending, that will help protect innocent people from such vicious and unjustified personal attacks as the Lewis have suffered. Unfortunately, this legislation may hurt innocent bloggers as well. I forgot to mention that said blogger also blocked my IP after I took exception to a comment he made on another blog, (http://outdoors.mainetoday.com/trailhead/007170.html#comments) so I couldn't post anything on his blog. Not very adult behavior.

    Fixing Maine’s troubled prisons is not an impossible task. In fact, if the state treated adult inmates more along the lines of how it treats juvenile offenders, prison critics — including, surprisingly, the new corrections commissioner, Joseph Ponte — think the prisons might not only become more humane, they might actually “correct” the prisoners.
